Legal action always remains a last resort. Every effort is made to resolve issues through discussions and formal correspondence with the MEQ before pursuing legal measures. All legal challenges are pre-approved by the QESBA Board of Directors which includes school board chairs and commissioners representation from all nine English school boards in Québec.
Protecting public English-language education in Québec
QESBA and its member school boards work to protect the rights and interests of Québec’s English-speaking public education community. The QESBA School Boards Legal Fund helps support this ongoing legal work.
The challenge to Bill 40 is one example of this work. It has resulted in important victories before both the Québec Superior Court (August 2023) and the Québec Court of Appeal (June 2025). The Québec government subsequently filed an application for leave to appeal the Bill 40 decision to the Supreme Court of Canada. We are awaiting the Court’s decision on whether it will hear the appeal.

Local governance allows our English communities to inform decisions affecting our schools, students and families, and protects the minority-langugage education rights guaranteed under the Canadian Charter of Rights and Freedoms.
